Today still a lot, may be even the most, people use a contract with an Indonesian to “own” a villa. Foreigners are not allowed to own property on their own name, so a few contracts are made up where the foreigner technically leases the property from the Indonesian citizen, but has the same rights (and obligations) as if he owned the property right out. There are plenty of forms in which these contracts appear, and the creators all believe that theirs is the best.

This construction is, besides used a lot, also criticized a lot. It is supposed not to be safe, and would give easy allowance for fraud and corruption. And there are plenty of stories going around where such a construction has gone wrong somewhere and has led to a loss, in one or another way.

Fact is however, that there are plenty of foreigners using this construction, and use it to live happily in Bali, are able to sell and buy property with consent of locals and local authorities, in total contrast with what the most harsh critics may say.

It seems however, that the Indonesian government has responded to the need of foreigners to being able to invest in a home in Bali, without needing an Indonesian ‘name holder’, while not immediately opening the gates for the rich to buy up ‘cheap’ Indonesian land.

This arrangement is called Hak Pakai. Hak means right, and Pakai means use, so it’s Right of Use.
Hak Pakai can be issued to (foreign) individuals, but also to companies, that are domiciled in Indonesia. Please note, domiciled in Indonesia. Hak Pakai is for people actually living here. It does not mean that you cannot leave Indonesia, or cannot own property in other countries as well. It just means that you spend a considerable time of the year in Indonesia.

Hak Pakai is not the same as leasehold (Hak Sewa). Leasehold is a notary contract with an owner, and the ownership certificate doesn’t change. Hak Pakai is an official certificate issued by the land offices, and can be given for Hak Milik or State owned property. As soon as a Hak Pakai certificate is issued, this certificate has precedent over any other title the property may have.

A foreigner can just have one Hak Pakai title on his or her name.

The Hak Pakai certificate is valid for an initial 25 years, and can be renewed after that. Some companies seem to offer prepaid renewals for up to a total of 100 years. It’s freely transferable to another name, so you can buy and sell existing Hak Pakai titles.

So, if you want property on your own name in Indonesia, and you are planning to live here, use the Hak Pakai arrangement.

Warga Jimbaran Desak BIP Segera Dibangun

Denpasar Pembangunan Bali International Park (BIP) yang akan digunakan sebagai lokasi KTT APEC 2013 tak kunjung dimulai. Meski mendapat penolakan dari beberapa elemen masyarakat, warga Jimbaran mendesak BIP segera dibangun.

BIP dibangun di atas lahan tandus di kawasan Jimbaran, Kuta, Bandung. BIP akan menjadi kawasan wisata terpadu Taman Internasional Bali. Di dalamnya dibangun tempat tinggal untuk sekitar 25 para kepala negara peserta KTT APEC 2013.

Namun, hingga kini pembangunan mega proyek yang diperkirakan menelan dana triliunan rupiah ini belum kunjung dimulai. Padahal, BIP telah mengantongi Keputusan Presiden (Kepres) dari SBY.

Kini, warga Jimbaran mendesak pembangunan BIP segera dimulai. Desakan itu disampaikan beberapa Kepala Lingkungan (Kaling) dan warga di wilayah Kelurahan Jimbaran.

“Segera bangun BIP karena akan menyerap ribuan tenaga kerja lokal,” kata Kepala Lingkungan Ubung Jimbaran, Wayan Benkur di Kantor Lurah Jimbaran, Selasa (1/11/2011).

Untuk mendukung pembangunan BIP, Kepala lingkungan di wilayah Kelurahan Jimbaran sudah membuat kesepakatan dukungan moral.

“Kami warga Jimbaran akan sangat bangga para kepala negara di dunia bermalam di desa kami. Jadi kami sangat berharap agar proyek BIP segera dilaksanakan,” ujarnya.

Hal senda disampaikan Kepala Lingkungan Buana Gubug I Wayan Sukamta menegaskan bahwa warga di wilayah Jimbaran tidak ada yang menolak proyek BIP.

“Lahan yang akan digunakan untuk membangun BIP adalah lahan tadah hujan yang gersang dan tandus. Jika menjadi kawasan wisata terpadu bertaraf Internasional memberikan manfaat positif dari segi ekonomi bagi warga sekitarnya,”ujarnya.

The Bali property market is open to foreign investment but only Indonesian citizens may own freehold land. The Bali property market is vulnerable to the global financial crisis because many developments are funded by US and European banks. Following is an overview of the Bali property market, enabling investors to make an informed decision on whether it meets their strategic investment objectives:

General Overview

1. Foreign ownership in the Bali property market is possible for residential real estate, commercial real estate, or as a property investment. Restrictions do apply, there are basically three options to legally acquire property in the Bali market, which are: a.) leasehold investment, where rights are negotiated with the landowner for up to 25 years b.) Indonesian nominee power of attorney agreement, basically a legal agreement where an Indonesian nominee is the registered owner. c.) PMA foreign investment company structure, which allows a foreign corporation to own land without an Indonesian partner for a period of 30 years.

2. Even though Bali suffered from terrorist activity in both 2002 and 2005, Bali still remains a potential property market for investors. This is indicated by the occupancy rate of both hotels and villas, which is currently at an average of 85 percent. The annual increase of property prices is said to be 10 percent according to several executives. This is supported by the Colliers International market report on Bali which shows an upward trend in occupancy rates for hotels across Bali.

3. According the Bali Tourism Board in January to March of 2010, there were a total of 551,186 visitors (a 18% increase from the same time last year). 22.1% of the tourists were from Australia; Japan and China accounted for approximately 12% and 10.6% respectively.

4. Generally, rates for office, retail and residential property has been increasing in recent years. However, there is currently concern that the Bali property market is at risk of suffering decline, especially villas and hotel development businesses, because a significant share of these are owned by foreign investors and financed by US and European banks. Locally financed developments are less at risk as the liquidity in the local banking industry remains strong due to the tighter lending criteria.

5. Taxes are payable in Indonesia for purchasing Bali real estate and selling Bali real estate. These taxes include notary tax, vendor and purchaser tax, and mortgage certificate tax.
